Apave Portugal Legal Notice

1.1. This Portuguese-language website (hereinafter, the “Website”) is provided by APAVE SA, a public limited company under French law, with its registered office at Rua do General Audran, No. 6, 92412 Courbevoie, registered in Paris under No. 527 573 141 00043. (hereinafter “Apave”).

1.2. Apave is part of the international Apave/Eurocontrol group. In Portugal, the group’s presence is ensured, in particular, through the company EISP QUALIDADE, UNIPESSOAL LDA, a legal entity under Portuguese law No. 513105336, headquartered at Rua Joaquim Agostinho, No. 183, 4410‑276 Canelas, Vila Nova de Gaia, Portugal, whose sole shareholder is the Spanish corporation Apave Inspection Spain, S.A.

1.3. This Legal Notice applies to the use of the Website accessible, in particular, via the address spain.apave.com/pt-PT and any other domains or subdomains associated with the online presence of EISP or Apave in Portugal (hereinafter collectively referred to as the “Website”).

1.4. For any questions regarding the Website or this Legal Notice, users may contact EISP QUALIDADE, UNIPESSOAL LDA, via email at apavept@pt.apave.com or through other contact information that may be provided on the Website itself.

1.5. Without prejudice to the provisions of clause 1.1, EISP acts as the point of contact for the Portuguese market.

1.6. Unless otherwise indicated, this Legal Notice also applies to pages, profiles, and accounts on blogs or social media managed by Apave or EISP, when directed at the Portuguese market.

2.1. Access to and use of the Website confer the status of user (hereinafter, the “User”) on the person doing so and imply full and unreserved acceptance of this Legal Notice, in the version in effect at any given time.

2.2. If the User does not agree, in whole or in part, with the terms of this Legal Notice, the User must refrain from using the Site.

2.3. Apave and EISP reserve the right to amend this Legal Notice at any time by publishing an updated version on the Website, without the need for prior notice. The amendments take effect upon their publication.

3.1. The Website serves primarily institutional and commercial purposes and is intended to provide information about the Apave Group, its activities in Portugal, the services it provides, accreditations, certifications, training, and other related information.

3.2. The information provided on the Website is general in nature and for informational purposes only. It does not, in and of itself, constitute technical, legal, or other forms of professional advice, nor does it constitute a binding contractual offer.

3.3. The content of the Website does not replace the need to directly consult commercial proposals, contracts, reports, opinions, or other specific documents that may be issued to the User by Apave, EISP, or other entities within the group.

4.1. The use of the Website and the submission of contact forms or requests for information do not, in and of themselves, constitute the formation of any contract between the User and Apave, EISP, or other entities within the group.

4.2. The contact forms available on the Website are intended solely to facilitate requests for clarification, additional information, or the initiation of a business relationship. Any proposal, quote, service agreement, or contractual amendment will always be formalized through appropriate channels (namely, email correspondence, the signing of proposals or contracts, or other means agreed upon by the parties).

4.3. Apave and EISP reserve the right to refuse, limit, or impose conditions on the provision of services, based on technical, commercial, legal, or compliance criteria that they deem justified in each case, particularly in situations involving non-compliance with legal or contractual obligations, the risk of money laundering, corruption, international sanctions, information security, or reputational risk.

4.4. Certain services or training courses made available through the Website may be subject to specific conditions, terms, and separate agreements. In the event of a conflict between such specific conditions and this Legal Notice, the specific conditions relating to the service in question shall prevail.

5.1. The User agrees to use the Site in a responsible, prudent, and careful manner, refrainingfrom using it for purposes contrary to the law, this Legal Notice, public order, or public morals, or in any manner likely to harm the rights and interests of Apave, EISP, other entities within the group, or third parties.

5.2. In particular, the User agrees not to:

• Upload, store, or disseminate, through the Site, content or computer programs that may cause damage, interruptions, malfunctions, or interference with the normal operation of the Site, or with the equipment, systems, or networks of Apave, EISP, other Users, or any third parties;
• Attempt to access or access restricted areas of the Site, computer systems, or networks belonging to Apave, EISP, or third parties without authorization;
• Use false identities, impersonate third parties, or conceal your identity in any way while using the Site;
• Using the Site for any purpose that is unlawful, illegal, or contrary to the rights of third parties (including intellectual property rights, trade secrets, or personal data).
  
   

6.1. All content on the Site, including, but not limited to, text, images, photographs, graphics, logos, icons, trademarks, trade names, graphic design, software, code, videos, sound files, as well as the Website’s structure and navigation architecture, are owned by Apave, EISP, other entities within the Apave Group, or third parties who have authorized their use, and are protected by applicable intellectual and industrial property laws.

6.2. Unless otherwise indicated, the reproduction, alteration, copying, distribution, transmission, disclosure, publication, making available, display, public communication, creation of derivative works, or any other form of exploitation, in whole or in part, of the Website’s content is prohibited, without the prior, express, and written authorization of Apave and/or the entity holding the respective rights.

6.3. The User may view the Site’s content on an electronic device and, where technically permitted, save or print copies strictly for personal and private use, provided that the User does not alter the content or remove copyright notices, trademarks, or other notices of reserved rights.

6.4. In particular, some of the content in Portuguese may consist of translations or adaptations of corporate information from the Apave/Eurocontrol group. In such cases, ownership of the copyright and other related rights remains with the group entities that produced or licensed them.

6.5. Nothing on the Website shall be construed as granting, by implication or otherwise, any license or authorization to use any intellectual or industrial property rights of Apave, EISP, other group entities, or third parties, beyond what is strictly provided for in this Legal Notice.

6.6. If and when the Website allows the User to publish, upload, or otherwise make content available, the User shall be solely responsible for such content and warrants that it does not violate the law or the rights of third parties, and agrees to hold Apave and EISP harmless from any claims related to such content.

7.1. The Website may include links to other web pages belonging to entities within the Apave Group (namely, the Group’s corporate pages and pages related to training or other areas of activity), as well as to third-party websites that may be considered useful for additional information

7.2. These websites are managed by separate entities and are subject to their respective terms of use, privacy policies, and cookie policies. Apave and EISP exercise no control over these websites and assume no responsibility for their content, accuracy, timeliness, legal compliance, policies, or practices.

7.3. The inclusion of links to other websites does not imply any endorsement, sponsorship, recommendation, or association by Apave or EISP with the entities referred to therein, the products or services they provide, or the information they make available.

7.4. The creation of links to the Site by third parties must comply with applicable law and may not, without Apave’s prior written authorization, imply a relationship of association, partnership, representation, or endorsement that does not exist.

8.1. Apave and EISP will use reasonable efforts to ensure that the Site remains available, up-to-date, and operating normally, but do not guarantee that access will be free from interruptions, failures, delays, or errors, nor that the Site is free from viruses, malware, or other harmful elements.

8.2. To the extent permitted by applicable law and without prejudice to mandatory provisions to the contrary, Apave and EISP shall not be liable for any damages, losses, or harm, whether direct or indirect, arising in particular from:

a) Interruptions, malfunctions, failures, delays, unavailability, or poor performance of the Site;
b) Cyberattacks, unauthorized intrusions, or the introduction of malicious software by third parties;
c) Misuse of the Site by the User or by third parties;
d) Decisions or actions taken based on information provided on the Site, which must always be confirmed through formal and specific channels (proposals, contracts, reports, opinions, etc.).

8.3. The User must use appropriate systems and tools (antivirus software, firewalls, security updates, etc.) to protect themselves against risks inherent in using the internet, and may not hold Apave or EISP liable for damages resulting from failure to adopt such measures.

9.1. Without prejudice to other specific channels that may be indicated on the Website, requests for information, clarifications, or complaints related to the Website or this Legal Notice may be directed to:

9.2. Apave and/or EISP will endeavor to respond to requests diligently and within a reasonable timeframe, without prejudice to any specific deadlines that may apply under applicable law. 

9.3. Any communication or notification sent by Apave or EISP to the User shall be deemed validly made when sent to the contact information provided by the User or posted on the Website itself.

10.1. Apave and EISP may, at any time, change, suspend, or discontinue the Site, in whole or in part, as well as modify, add, or remove any content, features, or services.

10.2. Apave and EISP may also amend this Legal Notice, and the new version will be effective as of its publication on the Site. Users are advised to review the Legal Notice periodically.

10.3. In the event of any discrepancy between different language versions of this Legal Notice, the Portuguese version shall prevail with respect to the use of the Site in Portugal.
